The First 2 Years Cover
The Manufacturers obligations
This part of the cover tells you what your Manufacturer must do if they are given notice of Defects or Damage to your home.
Your Manufacturer must take the actions in the blue panel below, but does not have to take action in the grey panel below:
What your Manufacturer is liable for:
Any defect or damage to your park home, which is notified by you within this period of cover. This includes:
- The whole structure of your park home: Every component
- Every fixture and fitting
- Defects to soft furnishings
- Defects to floor coverings
- Defects to internal decorations
What the Manufacturer is not liable for:
- Wear and tear
- Deterioration caused by neglect or failure to carryout normal and/or specific maintenance
- Dampness, condensation or shrinkage not caused by a Defect
- Anything caused by alterations or extensions to your home after the date of the Insurance Certificate
- Any cost or expense greater than that necessary to carry out workmanship repair of the Defect or Damage
- Any fault or defect arising from any electrical or gas installation with moving parts after 12 months from the date cover commenced
- Any fault or defect with soft furnishings, floor coverings and internal decorations after 12 months from the date cover commenced.
Section 2
The First 2 Years Cover
Platinum Seal Insurance Cover
In the event of you manufacturer not being around to carry out their obligations in Section 1, Platinum Seal insured protection will fulfil their obligations.
What Platinum Seal will pay for:
- All that is covered in Section 1
What Platinum Seal will not pay for:
- All that is excluded in Section 1
Section 3
Cover in years 3 to 10 (years 3 to 5 for homes being sited outside UK)
Platinum Seal will either pay for the items in the blue panel or, arrange for the necessary work to be carried out at their expense. Platinum Seal will not pay for the items in the grey panel.
What Platinum Seal will Pay for:
a. The full cost, if it is more than £350 (indexed) of putting right any actual physical major damage caused by defect in the structure of your home any of the following parts of the home:
- Chassis
- Load bearing walls
- External render, delamination and external vertical tile hanging
- Load bearing parts of the roof
- Load-bearing parts of the floors
- Floor decking, screeds and staircases, where these fail to support normal loads.
b. The cost of putting right any defect in a flue or chimney which causes a present or imminent danger to the physical health and safety of anyone normally living in the home
c. Any reasonable costs you incur by prior agreement with us for removal, storage and appropriate alternative accommodation
What Platinum Seal will not pay for:
- All that was excluded in years 1 and 2
- Any claim under A where the cost of repair is £350 or less, (indexed)
- Anything excluded by an endorsement by Platinum Seal on the Insurance Certificate;· Damage caused by shrinkage, thermal movement or movement between different types of materials
- Damage which is purely cosmetic, such as minor cracking, spalling or mortar erosion to brickwork, which does not impair the structural stability or weather tightness of the home or which only affects decorations
- Anything which was or could have been reported to the manufacturer under Sections 1 and 2
- Any defect in a ceiling which is not an enclosed part of the home e.g. balcony ceilings
- Anything listed in the General Exclusions of the insurance policy.
Exclusions
Platinum Seal will not be liable for:
a. Any home not built to BS3632 or EN1647 standards;
b. Any cost, loss or liability which is provided by legislation or which is covered by another insurance policy;
c. Anything excluded by an endorsement by Assist Insurance Company Ltd on the insurance certificate;
d. Anything affecting or caused by alterations or extensions to the home carried out after the date of the insurance certificate;
e. Any defect or damage resulting from compliance by the manufacturer with written instructions given on behalf of the first owner in respect of design, materials or workmanship;
f. Deterioration caused by neglect or failure to carryout normal and/or specific maintenance, as required and/or specified by the manufacturer, Park Operator and specific maintenance requirements specified within the Platinum Seal Warranty Agreement;
g. Dampness, condensation or shrinkage not caused by a defect;
h. Any reduction in the value of the home;
i. Loss of enjoyment, use, income or business opportunity, inconvenience, distress or any other consequential loss;
j. Any professional fees except those reasonably incurred with the insurers written consent. (Note: the insurer may in their absolute discretion waive this exclusion if they accept a claim which they had first rejected);
k. Cost or expenses greater than would have been paid or incurred by a reasonable person in the position of the owner spending his or her money;
l. Wear and tear;
m. Costs that have already been taken into account by Platinum Seal or by the manufacturer when making payment to or carrying out work for a previous owner;
n. Costs that are attributable to your unreasonable delay in pursuing a claim;
o. If you are not the first owner, anything which you knew about when you bought the home and which resulted in a reduction in the purchase price you paid or which was taken into account in any other arrangement;
p. Replacement or any undamaged item(s) solely because another item of the same nature, design or colour has to be replaced and the original items cannot be matched;
q. Loss or damage resulting solely from flooding from whatever source or from a change in the water table level;
r. Death, bodily injury, disease, illness or injury to mental health;
s. Any defect or damage to your home which is the responsibility or a direct action from the park owner;
t. Any defect or damage to your base and /pr defect or damage caused to your home as a result of a defect or damage to the base;
u. Any defect or damage as a result of the manufacturer, park owner or home owner not complying to the Platinum Seal Code of Practice;
